Hosted Instance TOS
These Terms of Service ("TOS") govern your use of the forumify SaaS hosting service. By using forumify hosted instances, you agree to comply with these terms.
1. Service Description
We provide SaaS hosting for forumify. This service is intended for small to medium-sized communities with fewer than 200 active users. While there are no hard user limits, prolonged usage exceeding these limits or disruptive usage may lead to termination. Notifications will be sent to you before you exceed any limits.
2. Your Responsibilities
- Resource Management: You must ensure your forum remains within the allocated resources.
- Spam Protection: You should utilize the built-in spam protection features to safeguard your forums.
- Regular Updates: You should regularly update your forums and plugins, and enable auto-updates to mitigate security vulnerabilities.
3. Prohibited Activities
- Software Restrictions: Only forumify software may be run on hosted instances.
- Illegal Content: Hosting illegal content is prohibited. We are not responsible for your content but will report any illegal activities to authorities and terminate the instance if necessary, based on our findings or notifications from hosting partners.
- Reselling: Hosted Instances are intended for your use only, you are not allowed to resell a hosted instance. The owner linked to your hosted instance must also be the primary user.
4. Payment Terms
- Subscription: You can choose between monthly or yearly subscriptions. Payments are due on the first day of the subscription period.
- Price Changes: We reserve the right to change subscription prices. You will be notified of any price changes before they take effect. If you do not agree with the new price, you may cancel the instance before the new price is applied.
- Refunds: Payments are non-refundable. You can terminate your instance at any time but we do not provide any refunds or credits for partial usage of your subscription. Your instance will remain active until the last day of your billing cycle.
5. Termination Policy
- Non-Payment: The instance will be terminated on the last day of the period of which payment was not received. You will receive a warning email if your instance is at risk of termination.
- Disruptive Usage: Instances that are taking up more resources than what is considered "normal usage" may also be terminated if no action is taken after repeated warnings.
- User Request: In case you request termination, the instance will remain active until the last day of the current billing cycle.
- Notification: The owner linked to the hosted instance will be notified through a forumify.net notification and email before any action is taken. Additionally, plenty of warnings will be visible on your hosting dashboard. Ample time will be provided to migrate all data to a self-hosted instance.
6. Data Privacy
- Data Ownership: You own all data on your instances. We will not share your data with any third parties except for our hosting partner, where the data is stored. forumify.net employees will only inspect your data when there is suspicious activity and on request of our hosting partner, authorities or internal investigations. You can request a data dump at any point, which will be provided within 10 business days.
- Data Deletion: Upon termination, all your data and backups will be irreversibly deleted.
7. Liability Limitations
- Development Status: We are not liable for damages due to outages, crashes, or issues arising from our hosting partners. forumify is an open-source platform and is exempt from any liabilities. We provide an up-to-date operating system and dependencies, updating forumify itself is up to you (section 2.3).
8. Dispute Resolution
- Support Tickets: Disputes will be handled through support tickets.
9. Governing Law
- Jurisdiction: These TOS are governed by the laws of Belgium.
10. Partners
We reserve the right to update these Terms of Service at any time. Any changes to the terms will be communicated to you via email. By continuing to use our service after receiving the update, you agree to the new terms.
